These Terms of Service ("Terms") govern your use of the Upsurra desktop application and the upsurra.com website (together, "Upsurra", "we", "us"). By downloading, installing, or using Upsurra, you agree to these Terms.
Upsurra is desktop software that helps creators turn their own video recordings into short vertical clips, on their own computer. Video processing happens locally on your device.
We grant you a personal, non-exclusive, non-transferable licence to install and use Upsurra. The free version applies a small watermark to exported clips. A one-time purchase (the "unlock") removes the watermark. Your licence key is for your own use and may not be shared, resold, or published.
You may use Upsurra only with content that you own or have the explicit rights and consent to use. You are solely responsible for the video and audio you process, and by using Upsurra you confirm you have those rights. You must not use Upsurra to record, capture, or process another person's or broadcaster's content without their consent. Your use is also governed by our Acceptable Use Policy. You agree not to create or distribute unlawful, infringing, or harmful content, and not to reverse engineer, decompile, or attempt to circumvent the software's licensing.
Purchases are processed by Paddle.com, which acts as the Merchant of Record and authorised reseller for Upsurra. Paddle's buyer terms also apply to your purchase.
Refunds are handled under our Refund Policy.
Upsurra is provided "as is", without warranties of any kind, express or implied. We do not guarantee that it will be uninterrupted, error-free, or fit for a particular purpose.
To the maximum extent permitted by law, Upsurra and its operator will not be liable for any indirect, incidental, or consequential damages, or for any loss of data or content, arising from your use of the software. Our total liability is limited to the amount you paid for Upsurra.
We may update these Terms from time to time. Continued use of Upsurra after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which the operator of Upsurra resides, without regard to conflict-of-law principles.
